Terms of Service — Love Journey

These Terms of Service (“Terms”) form a legally binding agreement between you (“user”, “you”) and Love Journey (“we”, “us”) governing your use of the Love Journey mobile app and related services (collectively, the “Service”).

By registering an account or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old. If your jurisdiction requires a higher age, you must meet that age.
You must have the legal capacity to enter into a contract under applicable law.
You may use the Service only for personal, non-commercial purposes.

2. Account

You agree to provide accurate information when creating an account (email, display name) and to keep it up to date.
Each user may hold only one account. Do not share your credentials with any third party.
You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Pairing

The Service operates on a pairing model: one account can be connected to at most one other account at a time.
By pairing, both users consent to sharing content within the shared space (chat, memories, timeline, touch) with each other.
Either party may unpair at any time. Unpairing may permanently delete shared content — back up anything you want to keep first.
Your pair code is a personal secret until you choose to share it with a partner.

4. Your content

4.1 Ownership

You retain all rights to the text, photos, videos, memories, and other content you create within the Service (“Your Content”).

4.2 License we need

To operate the Service, you grant us a limited, non-exclusive, royalty-free license, sub-licensable to our service providers solely for technical operation, to store, back up, encrypt, transmit, and display Your Content to you and to your paired partner. This license exists only to operate the Service and terminates when you delete the content or your account (except for technical backups kept for a reasonable period as described in the Privacy Policy).

4.3 Your responsibility

You represent and warrant that Your Content does not violate any law and does not infringe any third-party rights, including intellectual property, privacy, or publicity rights.

5. Prohibited conduct

You agree NOT to:

Post or transmit content that is illegal, threatening, harassing, violent, hateful, or fraudulent.
Post any sexual content involving minors or any form of child exploitation.
Send sexual content to someone who has not personally consented; share intimate images of others without their consent.
Impersonate another person or use a fake account to pair with another user.
Upload malware, viruses, or exploit code.
Attempt to gain unauthorized access to systems or to other users' data (reverse engineering beyond what the law permits, scraping, brute force, etc.).
Automate use of the Service via bots outside any official API we may provide.
Infringe copyrights, trademarks, or trade secrets.
Use the Service for commercial purposes, advertising, or spam.

We reserve the right (but have no obligation) to review and remove content, and to suspend or terminate accounts that violate these rules.

6. Push notifications

When you opt in, the Service sends pushes via FCM (Android) or APNs (iOS) for messages, touches, and reminders. You can disable individual notification categories in the app's settings or in your operating system.

7. Updates and changes to the Service

We may add, modify, or remove features over time.
We may require you to update the app to continue using it.
We aim for high availability but do not guarantee uninterrupted operation, and may perform scheduled or emergency maintenance.

8. Suspension and termination

You may terminate your account at any time using the delete-account feature in the app or by emailing support.
We may suspend or terminate your account if you violate these Terms, harm other users, or where required by law.
Provisions that by their nature should survive termination will do so (intellectual property, disclaimers, limitations of liability, governing law).

9. Intellectual property

The Service's source code, interface, logos, images, and other content we provide are owned by Love Journey or its licensors. You may use them only within the scope of these Terms; you may not copy, distribute, modify, or create derivative works beyond personal use.

10. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE”. To the maximum extent permitted by law, we make no warranty that:

The Service will always be available, error-free, or uninterrupted.
Data will never be lost, corrupted, or accessed without authorization.
The Service will meet your specific requirements.

You are responsible for backing up content you consider important.

11. Limitation of liability

To the maximum extent permitted by law, Love Journey and its affiliates will not be liable for indirect, incidental, consequential, or special damages, or for lost profits or lost data arising from or related to your use of (or inability to use) the Service. Our total aggregate liability, if any, will not exceed the amount you have paid us in the last 12 months, or VND 1,000,000 (one million Vietnamese dong) — whichever is greater.

12. Indemnification

You agree to indemnify and hold Love Journey harmless from any third-party claim arising from Your Content or from your breach of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of Vietnam. The parties will first attempt to resolve any dispute through good-faith negotiation. If that fails, the dispute will be submitted to the competent court in Vietnam.

14. Changes to these Terms

When we make material changes, we will notify you in the app and/or by email at least 7 days before they take effect. Continued use after the effective date constitutes acceptance of the updated version.

15. General

If any part of these Terms is held to be unenforceable, the remaining parts remain in effect.
Our failure to enforce a right is not a waiver of that right.
You may not assign your rights or obligations under these Terms without our consent.
